L’Autorità Garante della Concorrenza e del Mercato ha sanzionato i principali operatori della distribuzione automatica e semi-automatica (c.d. vending) di alimenti e bevande e la loro associazione di categoria, accertando l’esistenza di un’intesa anticoncorrenziale in violazione dell’art. 101 del Trattato sul Funzionamento dell’Unione Europea.
Secondo l’AGCM, dette imprese avrebbero posto in essere un accordo, volto a mantenere alto il livello dei prezzi e a preservare la propria redditività, consistente:
(i) nella ripartizione del mercato e della clientela, per effetto di un “patto di non belligeranza”, che prevedeva un meccanismo di compensazione;
(ii) nel coordinamento in materia dei prezzi di vendita, frenando condotte aggressive di prezzo da parte del mercato in occasione di eventi esterni (come, per esempio, l’adeguamento all’incremento dell’aliquota IVA dal 4 al 10% sui prodotti venduti mediante distributori automatici disposta dal D.L. 63/2013).
Per gli effetti, l’AGCM ha imposto sanzioni per complessivi euro 100.750.028,00.

He joined Orsingher Ortu Avvocati Associati as a partner in 2021. Edoardo assists clients on a wide range of issues in the field of European and Italian antitrust, competition, merger control and consumer law. He acquired a broad experience in TLC and regulated sectors such as media, energy and pharmaceuticals, advising clients before the AGCM, the European Commission, the Italian Administrative and Civil Courts and the European Courts. Since 2019, Edoardo has been a Non-Governmental Advisor of the European Commission’s DG Competition. He is Adjunct Professor of Antitrust Law at the Mercatorum University and the author of several publications on competition law, including a handbook and a monographic work. He was admitted to practice in 2009 and, since 2021, he has rights of appearance before the Italian Supreme Court. Edoardo speaks English and has a basic knowledge of French.
