Con provvedimento del 10 gennaio 2018, l’Autorità Garante della Concorrenza e del Mercato (AGCM) ha deciso di avviare un procedimento nei confronti delle società Kedrion S.p.A. e Grifols Italia S.p.A., al fine di verificare la liceità della loro partecipazione in forma associata a una gara per l’affidamento dei servizi di ritiro del sangue offerto da donatori nazionali, produzione di farmaci plasmaderivati e loro fornitura al sistema sanitario. Più in particolare, l’istruttoria concerne la gara bandita dall’agenzia Intercent-ER per conto di un raggruppamento di regioni e aggiudicata, nel settembre 2017, al RTI Kedrion-Grifols.
Secondo l’ipotesi accusatoria, i rapporti tra le società investigate, a partire dal RTI costituito per partecipare alla gara, potrebbero essere riconducibili a un’intesa in violazione dell’art. 101 del TFUE e/o dell’art. 2 della Legge n. 287/1990. L’AGCM ritiene, infatti, che le condotte poste in essere dalle imprese investigate potrebbero essere state volte a impiegare in maniera strumentale e anticoncorrenziale l’istituto del raggruppamento temporaneo di imprese, al fine di evitare la concorrenza diretta in occasione della gara e di precostituirsi un vantaggio incompatibile con il diritto antitrust.
Il procedimento dovrà concludersi entro il 31 dicembre 2018.

After his internship at the Italian Competition Authority (AGCM), he practised at Studio Legale Libertini – Scognamiglio, DLA Piper and Lipani Catricalà & Partners, where in 2017 he became the coordinator of the antitrust and regulatory practice. He joined Orsingher Ortu Avvocati Associati as a partner in 2021. Edoardo assists clients on a wide range of issues in the field of European and Italian antitrust, competition, merger control and consumer law. He acquired a broad experience in TLC and regulated sectors such as media, energy and pharmaceuticals, advising clients before the AGCM, the European Commission, the Italian Administrative and Civil Courts and the European Courts. Since 2019, Edoardo has been a Non-Governmental Advisor of the European Commission’s DG Competition. He is Adjunct Professor of Antitrust Law at the Mercatorum University and the author of several publications on competition law, including a handbook and a monographic work. He was admitted to practice in 2009 and, since 2021, he has rights of appearance before the Italian Supreme Court. Edoardo speaks English and has a basic knowledge of French.
