L’Autorità Garante della Concorrenza e del Mercato (AGCM) ha avviato nei confronti di Vodafone Italia e Telecom Italia due distinti procedimenti istruttori volti ad accertare l’esistenza di altrettanti abusi di posizione dominante riguardanti i servizi di invio massivo di SMS (SMS bulk).
Secondo l’impianto accusatorio, in particolare, Vodafone e Telecom Italia avrebbero violato l’art. 102 TFUE, ostacolando i concorrenti attivi nel mercato dell’invio di SMS massivi, abusando delle proprie posizioni dominanti nei rispettivi mercati di terminazione SMS su propria rete.
Le istruttorie dell’AGCM fondano su una segnalazione della società Ubiquità S.r.l., un operatore attivo nella prestazione di questa tipologia di servizi in concorrenza con Vodafone e Telecom Italia. Secondo il segnalante, gli operatori investigati, verticalmente integrati, avrebbero applicato tariffe sul mercato a monte della terminazione SMS sulle rispettive reti e tariffe sul mercato a valle dell’invio massivo di SMS che renderebbero il margine potenziale per i concorrenti nel mercato al dettaglio insufficiente a coprire i costi specifici per fornire i servizi ai clienti finali.
Entrambi i procedimenti dovranno concludersi entro il 30 novembre 2017.

He joined Orsingher Ortu Avvocati Associati as a partner in 2021. Edoardo assists clients on a wide range of issues in the field of European and Italian antitrust, competition, merger control and consumer law. He acquired a broad experience in TLC and regulated sectors such as media, energy and pharmaceuticals, advising clients before the AGCM, the European Commission, the Italian Administrative and Civil Courts and the European Courts. Since 2019, Edoardo has been a Non-Governmental Advisor of the European Commission’s DG Competition. He is Adjunct Professor of Antitrust Law at the Mercatorum University and the author of several publications on competition law, including a handbook and a monographic work. He was admitted to practice in 2009 and, since 2021, he has rights of appearance before the Italian Supreme Court. Edoardo speaks English and has a basic knowledge of French.
